If your migrant worker holds a work permit valid until December 11, 2569, what needs to be done is to submit an application for renewal by December 11, 2569. If submitted on time, work can continue until December 11, 2570, according to the Cabinet Resolution of July 14, 2569. The total government fee is 1,000 Baht per person (application fee 100 Baht + work permit fee 900 Baht). The e-WorkPermit system is now accepting applications — open since 8 September 2569 and closing on 11 December 2569 at 16.30, filed through eworkpermit.doe.go.th only, under the announcement of the Bureau of Migrant Worker Administration, Department of Employment, dated 2 September 2569.

The most common mistake is the understanding that "work can be done until December 11, 2569, then we'll deal with it." December 11, 2569, is both the work permit expiry date and the last day for submitting a renewal application simultaneously. It is not the case that you can renew after it expires. Anyone who fails to submit on time will lose their existing rights. As of 8 September 2569, there is no Cabinet Resolution or ministerial announcement opening a new registration round for migrant workers with irregular status to accommodate those who missed out.

This is not a small group. The Cabinet Resolution of July 14, 2569, states that there are approximately 720,000 workers in this group, and among them, 562,068 have not yet obtained a visa. These two questions are constantly asked interchangeably, and their answers are diametrically opposite. Check based on the work permit actually held by each employee.

If your employee is in group (B), the latest registration round was based on the Cabinet Resolution of November 11, 2568, which allowed submissions between December 12–26, 2568, and has since closed. As of 8 September 2569, there is no Cabinet Resolution or ministerial announcement opening a new round. There are news reports that the Ministry of Labour is considering guidelines for opening a new registration round, but there is no Cabinet Resolution yet and no announcement in the Royal Gazette. Therefore, there is no submission deadline yet, and no payment should be made to anyone to reserve a queue.

The remainder of this article concerns group (A) — renewing existing work permits.

Renewal Timeline: What to Do on Which Day

This renewal round has 4 important dates to remember, no more.

The summarized steps according to the Cabinet Resolution of July 14, 2569, are:

1. Check each individual work permit to confirm it is valid until December 11, 2569. The target group for this resolution includes those who received a work permit with a visa valid until December 11, 2569, and those who received a work permit until December 11, 2569, but failed to obtain a passport by July 31, 2569, or whose visa was processed but their passport expired before December 11, 2569.
2. Undergo a health check-up and register as an insured person (or obtain health insurance if not covered by the social security system) — According to Department of Employment circular No. รง 0316.5/ว 12389 dated August 13, 2569, the work permit or document stating permission to work until December 11, 2569, can be used as proof for health check-ups and health insurance.
3. Submit a renewal application through the e-WorkPermit system at eworkpermit.doe.go.th, the only channel, between 8 September and 11 December 2569 (the system closes at 16.30 on the last day). The applicant can be the migrant worker themselves, the employer, or a company authorized to bring migrant workers to work in the country. Where authority is delegated, a power of attorney with the stamp duty required by law must be provided.
4. Pay a fee of 1,000 Baht per person (application fee 100 Baht + work permit fee 900 Baht).
5. Apply for a visa within the permitted stay period until June 30, 2570.

For Lao and Myanmar migrant workers, who are the groups Exworker assists, the steps are as above. The most common issue encountered on-site is that the passport or equivalent document expires before the desired renewal date, requiring the document issue to be resolved before proceeding with the renewal. If such a case arises, allow extra time; do not wait until November.

The above steps and deadlines are in accordance with the Cabinet Resolution. Operational details will be in accordance with announcements from the Ministry of Interior and the Ministry of Labour to be published in the Royal Gazette. Documents to Prepare

The announcement of the Bureau of Migrant Worker Administration, Department of Employment, dated 2 September 2569 lists four items for the renewal application.

1. Passport or document used in place of a passport — for Myanmar nationals who do not yet hold a passport, it may be submitted later (this is not an exemption from holding one).
2. Result of the 6-disease health check under the Ministry of Interior announcement, from a state hospital or a private hospital linked to the Department of Employment's data system.
3. Document or evidence of insured status under Section 33, with two cases where health insurance may be used instead
   • Where the employer has changed and social security entitlement has not yet taken effect — use health insurance from a state hospital, or a policy from a non-life insurance company, with coverage of at least 6 months.
   • Where the business is exempt from paying social security contributions — for example domestic work, agriculture and livestock — use health insurance from a state hospital, or insurance specified by the Department of Employment, with coverage of at least 1 year.
4. Power of attorney where the worker does not file in person. Authority may be delegated to the employer or to a licensed company that brings migrant workers into the country, and the stamp duty required by law must be affixed.

The list above is what the system asks for at the point of filing. Application forms and other supporting documents may vary as specified by the Department of Employment in each round, so check the current list in the e-WorkPermit system before preparing documents. Employer (Individual)

• Copy of the employer's house registration
• Copy of the employer's national ID card
• Clear photographs of the business, showing the nature of operations and the actual condition of the establishment

Employer (Juristic Person)

• Company certificate (Department of Business Development), not older than 3 months from the submission date
• Copy of house registration and national ID card of the authorized director
• Current photographs of the business

Employee

• Work permit (Smart Card) or substitute document if the card has not yet been received
• Receipts for related fees
• Passport or equivalent travel document that has not expired
• Valid visa stamp in the passport — Migrant workers under Cabinet Resolutions use the visa stamp authorized in that specific resolution round, not the same type of visa as general foreign nationals. If unsure what type of visa the employee holds, check with the provincial employment office before submitting.
• Non-Thai national identification card (pink card) for those who hold this card
• Medical certificate and proof of health insurance or registration as an insured person
• Front-facing photograph, white or blue background, taken no more than 6 months ago

What Happens If You Miss the December 11, 2569 Submission Deadline?

Here, I will write only what can be factually confirmed, nothing more.

What is certain is that the original work permit expires on December 11, 2569. If there is no work permit but work continues, it will constitute an offense under the Royal Ordinance on the Management of Migrant Worker Employment, which affects both parties.

• For the employee — A migrant worker working without a work permit is subject to a fine of 5,000–50,000 Baht, with no imprisonment. After paying the fine, they will be deported from the Kingdom. Furthermore, those penalized for this offense cannot apply for a new work permit until at least 2 years after the penalty has been served.
• For the employer — Employing a migrant worker who does not have a work permit is subject to a fine of 10,000–100,000 Baht per migrant worker. If the offense is repeated, the penalty is imprisonment for up to 1 year or a fine of 50,000–200,000 Baht per person, or both imprisonment and fine, and a prohibition from employing migrant workers for 3 years from the date of the final court judgment.

What remains unanswered is that the Cabinet Resolution of July 14, 2569, does not specify a channel for late submissions for those who fail to submit within the deadline. As of 8 September 2569, there is no Cabinet Resolution opening a new registration round to accommodate this. Therefore, we cannot state whether there will be a catch-up round. What can be said is: do not plan based on the assumption that there will be a catch-up round, as there is currently no provision for it.

Frequently Asked Questions

Should I wait until closer to December 11, 2569, before submitting?

No. The e-WorkPermit system has been accepting applications since 8 September 2569, so you can file as soon as your documents are ready and you should do so as early as possible, because closer to the deadline, health check-up queues and submission queues will be congested nationwide. In previous rounds, some people missed the steps, leading to a Cabinet Resolution on March 10, 2569, to extend the deadline, which is something no one can guarantee will happen again.

After submitting, can the employee stay in Thailand while awaiting visa processing?

Yes. According to the Cabinet Resolution of July 14, 2569, those who have submitted may stay in the Kingdom until June 30, 2570, to proceed with visa application. Once the visa is processed, permission to stay will be granted until December 11, 2570.

What are the costs for renewal?

The government fee is 1,000 Baht per person, divided into an application fee of 100 Baht and a work permit fee of 900 Baht, according to the Cabinet Resolution of July 14, 2569. Has the employee lost their rights if they failed to obtain a passport by July 31, 2569?

Not yet. The Cabinet Resolution of July 14, 2569, includes as its target group those who received a work permit valid until December 11, 2569, but failed to obtain a passport by July 31, 2569, and those whose visa was processed but their passport expired before December 11, 2569.

Can Cambodian employees renew in this round?

The Cabinet Resolution of 2569 for work permit renewal specifies only Lao, Myanmar, and Vietnamese nationalities. It does not cover Cambodian nationality, for whom renewal was postponed according to the Cabinet Resolution of December 2, 2568. As of 8 September 2569, there is no new Cabinet Resolution extending renewal for this group. Employers with Cambodian employees should check their individual status with the provincial employment office in their area.

Can the employer be changed during this period?

The Cabinet Resolution granting leniency to this group does not specifically address changing employers. Therefore, changing employers must be done according to the Department of Employment's criteria. It is advisable to inquire with the provincial employment office on a case-by-case basis.

Can I submit it myself, or do I need to use a company?

You can submit it yourself. The applicants according to the Cabinet Resolution of July 14, 2569, are the migrant worker themselves, the employer, or a company authorized to bring migrant workers to work in the country. Employers with a few employees and complete documents can usually manage it themselves.
