Notification of Residence for Foreigners under Section 38 (TM.30)

Something homeowners shouldn't realize when it's too late...

The notification of residence for foreigners under Section 38 (TM.30) is an issue many homeowners or occupants overlook, thinking it's complicated or "nothing serious." However, in reality, neglecting it can lead to major problems.

1. What does the law state?

According to the Immigration Act B.E. 2522, it states: When a foreigner (alien) stays in a dwelling, hotel, or any type of accommodation, the homeowner/manager must notify the immigration officer within 24 hours from the time the foreigner takes up residence.

2. Why does it become a "major penalty"?

Although the law may seem straightforward, the consequences are more than just fines:

Civil Penalties

General homeowner: 800 - 2,000 Baht/person
Hotel/Company: 2,000 - 10,000 Baht/person

VISA Extension Issues

If there is no name in the TM.30 system, officials will immediately refuse transactions (VISA/90-day report) until the fine is paid.

Credibility

This may cause the tenant to lose their right of residence and lead to lease termination or legal disputes.

3. Who is responsible for notifying?

  • Homeowner: The person whose name is on the house registration book
  • Occupant: The person who rents the entire house or has management authority
  • Hotel Manager: In the case of an establishment

Current Notification Methods (Much Easier)

You don't always have to travel to Immigration. Currently, it can be done through online channels:

  • Website: section38.immigration.go.th
  • Application: Section38 (iOS and Android)
  • Mail: Send the form via registered mail

Documents to Prepare (for online)

  • Copy of land title deed or lease agreement
  • Copy of homeowner's ID card
  • Copy of foreigner's passport and VISA

Our Recommendation

For homeowners with foreign tenants, you should register for a User/Password in the online system in advance. When new guests or tenants arrive, you will be able to notify via mobile within 5 minutes, reducing the risk of fines and helping tenants conduct transactions in Thailand smoothly.
